SECTION 1. GENERAL PROVISIONS & LEGAL IDENTIFICATION

1.1. These Terms of Service (hereinafter: "Terms") govern the rules, scope, and conditions for utilizing GoUpTower: the web platform accessible at https://gouptower.com and the GoUpTower application for iPhone distributed through Apple's App Store (together, hereinafter: "Service" or "Platform"). Except where a clause says otherwise, everything in these Terms applies equally to both.

1.1a. One account, two ways in. The App and the website are the same Service and the same Account. Data entered in one appears in the other. A Subscription Plan bought in either place works in both, subject to Section 5A.

1.2. The Service is operated and owned by Aleksander Chomiński, conducting an unregistered business activity (działalność nierejestrowana) under the laws of the Republic of Poland (hereinafter: "Service Provider" or "Administrator"). Due to the legal nature of an unregistered business activity, no VAT ID (NIP) or physical business registry address is applicable.

1.3. Official contact for general support, technical, or administrative matters is available at: support@gouptower.com. Inquiries directed strictly to the owner can be sent to admin@gouptower.com.

1.4. Accessing, browsing, registering an account, or purchasing subscriptions on the Platform constitutes full acceptance of these Terms.

SECTION 2. DEFINITIONS
  • Platform / Service: The web application located at gouptower.com, including code, subpages, databases, and UI elements.
  • User: Any natural or legal person utilizing the Services of the Platform.
  • Account / Account Basic: An individual user profile created via the registration form, "Sign in with Google", or "Sign in with Apple", secured via password and email verification. An Account made with Google or Apple has no password known to the User; deleting it is confirmed by typing DELETE instead.
  • Subscription Plan: Access tiers (Basic, PRO, Advanced) dictating feature availability, view limits, and automated notifications.
  • WINDA ID: Global Wind Organisation unique technician ID formatted strictly as 2 uppercase letters and 6 digits (e.g., AB123456).
  • Job Offer / Posting: A structured informational card listing wind turbine project requirements.
  • Training Provider: Certified training facility displayed on the Platform's Interactive Map.
  • External Apply Link: Hyperlink directing Users directly to an external employer portal or Applicant Tracking System.
  • App: The GoUpTower application for iPhone, obtained from the App Store operated by Apple Inc. and its subsidiaries ("Apple").
  • In-App Purchase: A Subscription Plan bought inside the App, billed by Apple to the User's Apple Account rather than by the Service Provider.
  • Push Notification: A message the App may send to the User's device — a new job offer, a platform announcement, a high-wind alert, a reminder the day before a rotation, or referral points credited.
  • Referral Points: A promotional balance earned by inviting other Users, redeemable only for periods of Subscription access under Section 5B. Points are not money, are not transferable, and have no cash value.
SECTION 3. TECHNICAL REQUIREMENTS & ACCESSIBILITY

3.1. Standard usage requires an Internet-connected device, an updated browser supporting JavaScript and Cookies, and an active email address.

3.2. The Administrator reserves the right to activate "Maintenance Mode" at any time for security audits or system upgrades, temporarily restricting non-admin access.

SECTION 4. ACCOUNT REGISTRATION & SECURITY

4.1. Account creation is free. Manual registration requires providing First Name, Last Name, Email, and a password meeting parameters: min. 8 characters, 1 uppercase letter, 1 digit, 1 special character.

4.2. Email Verification: Unverified accounts remain locked until the activation link is clicked.

4.3. Accounts are non-transferable; sharing credentials with third parties is strictly prohibited.

SECTION 5. SUBSCRIPTIONS, VIEW LIMITS & INVOICING

5.1. The Platform offers three subscription tiers:

5.2. Weekly View Limit: Browsing the offer list is always free and unlimited, for registered Users and visitors alike. What is metered is opening an offer in full. Basic and PRO accounts are subject to a rolling limit of 5 and 12 unique job offer views per 7-day period respectively; the Advanced Plan is unlimited. Re-opening an offer already viewed within the period does not consume a further view. Reaching the limit restricts full offer details until the rolling period expires or an upgrade occurs. The limits in force at any time are those shown on the pricing section of the home page, which prevails if these Terms fall out of step.

5.2a. Visitors who are not registered: may browse the complete offer list and read a substantial preview of any offer, but require a free Account to read an offer in full or to reach the external apply link.

5.3. Payment Gateway: Paid plans are securely processed via Stripe Payments Europe Limited, The One Building, 1 Lower Grand Canal Street, Dublin 2, Ireland. Card details are entered on Stripe's own hosted checkout and are never received or stored by the Service Provider. Transactions occur in Euros (EUR) or converted currencies. Subscriptions may be canceled anytime in the Dashboard.

Invoicing & Receipt Rules

5.4. Invoicing and Receipts: The Platform is not obligated to automatically issue and send a receipt or invoice after every subscription purchase.

5.5. B2C Purchases (Private Individuals): A private individual (consumer) may request a receipt for their purchase. Such requests must be submitted via the Platform's contact form no later than 3 months from the end of the month in which the purchase was completed.

5.6. B2B Purchases (Business Entities): A business entity or sole trader requiring an invoice must submit a request via the Platform's contact form. Because the Service Provider operates as an unregistered business activity under Polish law (działalność nierejestrowana), the issued document will be a strictly VAT-exempt invoice (faktura bez VAT / faktura dla podatników zwolnionych).

Consumer Rights (B2C)

5.7. Consumer Right of Withdrawal: Users acting as Consumers (B2C) generally have the right to withdraw from a distance contract within 14 days without giving any reason.

5.8. Waiver of Withdrawal Right for Digital Content: By purchasing a Subscription Plan and requesting immediate access to PRO or Advanced features, the Consumer explicitly consents to the commencement of performance before the expiration of the 14-day withdrawal period and acknowledges that they thereby lose their statutory right of withdrawal once the service delivery begins.

SECTION 5A. PURCHASES MADE INSIDE THE APP (APPLE)

5A.1. Who bills you. A Subscription bought on the website is billed by the Service Provider through Stripe (Section 5.3). A Subscription bought inside the App is an In-App Purchase billed by Apple to your Apple Account. The same plans and prices are offered in both places, but they are separate billing relationships and only one of them is ever active for a given Account at a time.

5A.2. Auto-renewal. In-App Purchases are auto-renewing subscriptions. Payment is charged to your Apple Account at confirmation of purchase. The subscription renews automatically for the same period and price unless auto-renew is switched off at least 24 hours before the end of the current period. Your Apple Account is charged for the renewal within the 24 hours before the period ends.

5A.3. Managing and cancelling. An In-App Purchase is managed in Settings → your name → Subscriptions on your device, or from the App's Account screen, which opens the same panel. The Service Provider cannot cancel, change or refund an Apple subscription on your behalf. Cancelling stops the next renewal; access continues to the end of the period already paid for.

5A.4. Refunds. Refunds for In-App Purchases are handled by Apple under Apple's own terms, at reportaproblem.apple.com. Section 5.7 and 5.8 (statutory withdrawal and its waiver) continue to apply to purchases made on the website.

5A.5. Deleting the App. Removing the App from your device does not cancel a subscription and does not delete your Account. Cancel in Apple's Subscriptions panel, and delete the Account separately if that is what you intend (Section 8.1).

5A.6. Apple's position (required terms)

  • These Terms are concluded between the User and the Service Provider only, and not with Apple. Apple is not a party to them.
  • Apple has no obligation whatsoever to furnish any maintenance or support for the App.
  • If the App fails to conform to any applicable warranty, the User may notify Apple, and Apple will refund the purchase price of the App (if any). To the maximum extent permitted by law, Apple has no other warranty obligation with respect to the App.
  • The Service Provider, not Apple, is responsible for addressing any claim relating to the App, including product liability, any failure to conform to legal requirements, and claims under consumer protection or similar legislation.
  • The Service Provider, not Apple, is responsible for the investigation, defence, settlement and discharge of any third-party claim that the App infringes that party's intellectual property rights.
  • Apple and its subsidiaries are third-party beneficiaries of these Terms as they relate to the App, and upon acceptance Apple has the right to enforce them against the User.
  • The User represents that they are not located in a country subject to a U.S. Government embargo or designated as a "terrorist supporting" country, and are not listed on any U.S. Government list of prohibited or restricted parties.
SECTION 5B. REFERRAL PROGRAMME & POINTS

5B.1. How points are earned. Each Account has a personal invitation link. When a new User registers through that link, 100 points are credited to the inviting Account — but only once both people have completed the profile fields the programme requires (first name, last name, WINDA ID, platform types, year started, recent projects). Until then the referral is shown as pending.

5B.2. What points buy. Points may be redeemed only for periods of Subscription access: 500 points for one month of PRO, 900 points for one month of Advanced. The period is added to the end of any period already paid for.

5B.3. What points are not. Points are a promotional balance. They are not money, not a voucher, not transferable between Accounts, cannot be sold or exchanged, and have no cash value. They cannot be refunded and are lost when the Account is deleted.

5B.4. Apple-billed subscriptions. Points cannot be applied to a subscription billed by Apple, because the Service Provider does not control that billing. Cancel the Apple subscription first, or spend the points once it has ended.

5B.5. Fair use. Referring yourself, creating additional Accounts to earn points, using disposable or fabricated identities, or any other manipulation of the programme is a breach of these Terms. The Service Provider may withhold or reverse points obtained that way, cancel access granted with them, and suspend the Accounts involved (Section 8.4).

5B.6. Changes. Point values, prices in points, and the qualifying conditions may be changed or the programme withdrawn, announced under Section 9.3. Points already credited remain redeemable for 12 months from the announcement.

SECTION 6. CAREER HUB, ROTATION PLAN & QUALIFICATION TRACKING

6.1. Qualification Tracking ("My Certificates"): Users may log GWO modules (WAH, FA, MH, FAW, SS, ART, BTT), OEM training (Vestas, Siemens Gamesa, GE), Medical certs, and manually input custom training records. Users can set custom expiration dates or mark them as non-expiring.

6.2. Disclaimer of Authenticity: The Platform does not permit uploading physical documents or scans. All data within "My Certificates" and "Profile Details" is populated voluntarily by the User for their personal organizational use. The Administrator does not verify, validate, or endorse the authenticity, accuracy, or legal validity of the certificates or experience claims entered by the User. The Administrator bears no responsibility or liability for any false, inaccurate, or misleading information provided by the User to third parties or potential employers.

6.3. PRO & Advanced Plan Export: Subscribers of the PRO and Advanced Plans may generate a PDF report of their logged certificates (featuring an automated QR code). This document is strictly an unverified summary of user-inputted data and does not constitute an official legal or educational credential.

6.4. Profile & Statistical Data: Users may voluntarily provide detailed career information, including industry tenure, turbine platforms worked on, and project histories. The Administrator processes this specific career data strictly for internal statistical purposes and platform development. This data is not sold or shared with external third parties.

6.5. "My Rotation Plan" & Tax/Legal Disclaimer: The Platform provides a calendar-based rotation planner for organizing project days, home days, training, and vacation. The app calculates days spent in specific countries based solely on User input. This tool is for personal convenience and time-management only. It does not constitute legal, financial, or tax advice. The Administrator is strictly not liable for any tax, residency, or legal implications, nor for any discrepancies in reporting to state authorities resulting from the use of this calculation tool.

6.7. CV Builder: Users may generate CV documents from data already held in their Account, save any number of named drafts, and export them as PDF. Free Accounts may export a CV containing up to three projects or workplaces; PRO and Advanced Accounts are unlimited. As with 6.2, the Administrator does not verify any statement a CV makes — a generated CV is a formatted presentation of the User's own entries and is not a credential, a reference, or a verified employment record. The User is solely responsible for its accuracy and for any use made of it.

6.8. Virtual CV — public sharing: A User may optionally publish one saved CV at a randomly generated web address, and display that address as a QR code. Sharing is disabled by default and must be switched on by the User. While enabled, anyone holding the address can view the CV and download the contact details, without logging in. Switching sharing off, or deleting the Account, disables the address immediately, but neither can retrieve copies already viewed, saved or forwarded. The decision to publish, and the choice of what a published CV contains, rests entirely with the User.

6.9. Live Time Tracker: Available inside "My Rotation Plan", this records working hours started and stopped by the User against a project on their calendar. Totals feed the "Logged Hours" view and the timesheet export. Subject to the same limitation as 6.5: it is a personal convenience record, not an authoritative record of working time, and is not evidence for payroll, invoicing, or any employment or regulatory dispute. The Administrator is not liable for lost, incomplete or inaccurate entries, including those caused by a timer left running or never started.

6.10. Introductory walk-through: New Accounts are shown a short guided introduction, which may be skipped at any time and replayed later from the Tutorials tab. The Administrator records whether it was completed or skipped, and may send an occasional reminder to Users who skipped it. Users may object to such reminders at any time.

6.11. Wind readings and high-wind alerts (App only). The App can show the wind where your phone is, and send a notification when it passes a limit you set yourself. The readings come from Apple Weather and are advisory information for personal convenience only. They are not a measurement at your turbine, not a forecast for your site, and not a safety system. An alert may be late, inaccurate, or not arrive at all — it depends on the weather service, your network, your device's settings and battery, and on a scheduled job that runs periodically rather than continuously. Never use it to decide whether it is safe to climb, lift or work. Always follow your employer's rules, your site's measured wind data and your own risk assessment. The Service Provider accepts no liability for any decision taken in reliance on a reading or an alert.

6.12. Location (App only). Wind readings and "nearest training centre first" need your device's location. Permission is asked for in the App and may be refused or withdrawn at any time in iOS Settings; the rest of the App continues to work without it. If high-wind alerts are switched on, the approximate position is stored on the server so the alert can be checked while the App is closed — see the Privacy Policy.

6.13. Notifications (App only). Push notifications are sent only if you allow them on the device, and each kind can be switched off in the App under Account → Notifications. They are a convenience, not a guarantee of delivery: 6.11 applies to all of them.

6.14. Live Time Tracker on the Lock Screen (App only). A running session may be displayed on the Lock Screen and in the Dynamic Island. This is a display of your own timer and is subject to 6.9 in full.

6.15. Packing list (App only). The packing checklist is stored on your device, not on the Service Provider's servers. It is not backed up by the Service Provider, does not move to a new phone with your Account, and is lost if the App is deleted.

6.16. Export to your device calendar (App only). You may write your rotation plan into your iPhone's Calendar. The App asks for permission to add events and never reads what else is in your calendar. Exported events are a copy: later changes to the plan do not reach them until you export again, and deleting a rotation in GoUpTower does not remove an event already written. Removing exported events is done in the Calendar app.

6.6. German WAH Rule Warning: The system automatically flags regional regulatory variations, such as Germany requiring GWO Working at Heights refreshers every 12 months instead of 24 months. Such flags are purely advisory.

SECTION 7. INTELLECTUAL PROPERTY & JOB POSTINGS

7.1. GoUpTower acts strictly as an indexing aggregator and is not an employment agency, a recruiter, or an intermediary. Clicking an external apply link redirects the User directly to a third-party hiring system. GoUpTower does not receive, store or forward the application a User then submits there. CV documents built with CV Builder (Section 6.7) are stored in the User's own Account for their own use; the Administrator never sends them to an employer, and no employer is given access to them.

7.2. Structured Data and Referential Use: The Platform constructs job offers using exclusively objective data points. GoUpTower does not copy, paste, or reproduce creative, copyrighted textual descriptions from original employer postings. The lists of OEMs and training certificates are universally recognized, global industry standards and publicly available information.

7.3. All trademarks and company names are used strictly for informational, referential, and descriptive purposes in accordance with applicable industrial property laws.

7.4. Automated data scraping, crawling, or AI indexing of the platform without written consent is strictly prohibited.

7.5. Independent Platform Disclaimer

GoUpTower is an independent web application and directory service. The Platform is not affiliated, associated, authorized, endorsed by, or in any way officially connected with the Global Wind Organisation (GWO), any Original Equipment Manufacturer (OEM), or any certified training facility. All product and company names are trademarks™ or registered® trademarks of their respective holders; their use on the Platform does not imply any affiliation with or endorsement by them.

SECTION 8. ACCOUNT TERMINATION & DELETION

8.1. By the User. An Account may be deleted at any time from the Dashboard on the website, or from Account → Delete account in the App. Deletion removes the profile, certificates, rotation entries, timesheets, CV documents and any active Virtual CV share link. It cannot be undone.

8.2. Effect on a paid subscription. Deleting an Account during a paid period does not by itself create a right to a refund; see 5.7 and 5.8. Cancel the subscription first if you wish it not to renew.

8.3. Retained records. Records the Service Provider must keep by law — principally accounting records of a completed purchase — are retained for the statutory period even after deletion, as described in the Privacy Policy.

8.4. By the Administrator. The Administrator may suspend or terminate an Account that breaches these Terms, in particular 4.3 (credential sharing) and 7.4 (automated scraping), or where required by law. Where circumstances allow, notice will be given to the email address on file.

8.5. Inactivity. An Account not logged into for 36 months may be deleted after notice by email.

SECTION 9. SERVICE AVAILABILITY & CHANGES TO THESE TERMS

9.1. The Platform is provided on a best-effort basis. No specific level of uptime is guaranteed, and features may be added, changed or withdrawn as the Platform develops.

9.2. Where a change materially reduces a feature included in a paid plan, affected Users will be notified by email before it takes effect and may cancel the subscription without penalty for the remainder of the paid period.

9.3. These Terms carry a version number and date at the top of this page. Material amendments will be announced on the Platform and take effect no earlier than 14 days after announcement, except where an earlier date is required by law. Continuing to use the Platform after that date constitutes acceptance.

SECTION 10. COMPLAINTS & GOVERNING LAW

10.1. Complaints must be sent to support@gouptower.com and will be evaluated within 14 calendar days. Disputes shall be resolved under the jurisdiction of the Service Provider's location under Polish law.

10.2. Out-of-Court Dispute Resolution (ODR): Consumers residing in the EU have the right to use the European Online Dispute Resolution (ODR) platform to resolve disputes out of court. The platform is available at: http://ec.europa.eu/consumers/odr.
